ASSUMPTION OF RISK LIABILITY WAIVER & RELEASE On behalf of my minor child/children, I hereby give permission for my child/children to participate in the Christ Point Academy (CPA) classes. I hereby warrant that both myself and my child are familiar with the risks associated with participation in CPA activities. I acknowledge that my child’s participation in this program is wholly voluntary. I do hereby agree and consent to my child’s participation in the CPA program during this school year and do assume all risks and hazards which are conducted as part of the associated activities. I hereby release, absolve, indemnify, and hold blameless CPA, its officers, directors, employees, contracted employees, independent contractors, instructors, agents, organizers, and volunteers of any and all liability for damage, injury, or expense of any kind arising out of or connected with my child’s participation in CPA. I understand that in case of a medical emergency, my own personal medical plan will be used if available; if not, medical aid may be sought while I am being contacted. In the event of any illness or injury, I hereby consent to whatever examination, diagnosis, or treatment and the hospital care from a licensed dentist, physician, and/or surgeon as deemed necessary for my child’s safety and welfare. I understand that the resulting expenses will be my responsibility and not CPA’s, or any affiliates. As a condition of participation in the CPA program by the student named in this application, I acknowledge that I have read this consent form, and knowingly, on behalf of my child, assume all of the risks associated with participating in any way in the CPA program. As consideration for being permitted to participate in the CPA program, I hereby agree that I, my assignees, heirs, distributees, guardians, and legal representatives will not make claim against, sue or attach the property of CPA or their Affiliates or the supplier of any of the equipment used in these activities for injury or damage resulting from negligence, failure of care, omission or other acts, howsoever caused by an employee, agent or contractor of CPA and any affiliate as result of incidental to my child participation in these activities. I hereby release, to the fullest extent permitted by law, CPA and the affiliates, from any and all actions, claims, demands, or liabilities that I, my assignees, heirs, distributes, guardians, and legal representatives now have or may hereafter have for injury or damage resulting from my son/daughter’s participation in these activities irrespective of whether the same is based on breach of warranty, negligence, strict liability or any other theory or recovery. Parent/Legal Guardian acknowledges that CPA is not a licensed childcare or daycare facility. I have read this agreement and agree to the conditions stated above.
Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19 The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Christ Point Academy (CPA) has put in place protective measures to reduce the spread of COVID-19; however, CPA cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending activities on the campuses of CPA could increase your risk and your child(ren)’s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and on behalf of myself, my child(ren), my and spouse/co-parent of child(ren) voluntarily assume the risk that my child(ren) and I, and any member of my family, may be exposed to or infected by COVID-19 by attending activities on CPA campuses and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 while on CPA campuses may result from the actions, omissions, or negligence of myself and others, including, but not limited to CPA employees, agents and representatives, volunteers, program participants and their families and/or any other individual who may be present upon school property or in attendance at any school activity. I voluntarily agree to assume, on behalf of myself, my child(ren), and my spouse/co-parent of child(ren) all risks and accept sole responsibility for any injury to my child(ren),myself and any member of my family, (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I, my child(ren) and/or members of my family may experience or incur in connection with my child(ren)’s attendance in activities or participation in CPA programming (“Claims”). On my behalf, and on behalf of my children and/or members of my family, I will advance no claim and I hereby release, covenant not to sue, discharge, defend, indemnify and hold harmless the CPA, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of CPA, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any CPA activity. Additionally, it should be noted that the laws of the State of Alabama provide for numerous immunities for organizations / schools should something occur to a student or to the family of a student as a result of activities on school property. In addition to this Agreement, these immunities remain intact.
